The ApartSW Privacy Policy

This ApartSW Privacy Policy ("Privacy Policy") explains what information we may collect about you when you register for or use our Websites or our Services, why do we collect it, what control you have over it and how we may use, share or disclose such information.

Unless otherwise defined herein, capitalized terms shall have the meanings assigned to such terms set forth in the ApartSW Terms of Use Agreement which incorporates this Privacy Policy by reference.

We're committed to respecting and protecting you privacy, including any Personal Information you may provide to us and to offer a secure environment for your registration for or your use of our Websites or our Services.

“Personal Information” is information about you that is personally identifiable to you, like your name, mailing address, email address, or phone number, as well as other non-public information that is associated with the foregoing.

“Anonymous Information” means information that is not associated with or linked to your Personal Information; Anonymous Information does not permit the identification of individual persons.

By registering for or using our Website or our Services, you expressly consent to the collection, processing, storage, transfer and disclosure of your information as set out in this Privacy Policy. If you do not agree with each and every provision in this Privacy policy and in the associated Agreement please stop using our Websites or our Services.

You may at any time review, update or delete your Private Information and your optional privacy settings in your Account settings. If you hold an Organisational Account you may need to contact your organisation Administrator to do so.

Your Personal Information may be processed by ApartSW or its third party Providers in the country where it was collected as well as transferred to and processed in other countries (including Canada and the United States) where laws regarding processing of Personal Information may be less stringent than the laws in your country.

We may from time to time update this Privacy Policy. The updated Privacy Policy will be presented on this page and will become effective immediately. We'll also notify you of any upcoming significant Privacy Policy updates via our Websites and our Services and by email to your email address registered to your Account. We will also keep all previous published versions of the Privacy Policy and make them available from this page.

We may, but only with your explicit consent: (i) collect, use, share or disclose other types of Personal Information than those described in this Privacy Policy; and (ii) collect, use, share or disclose your Personal Information in other ways or for other purpose than those described in this Privacy Policy.

Security

ApartSW Consulting uses industry reputable certified third party Providers for secure operation and maintenance of our Websites and our Services and protection of your Personal Information and privacy.

All our Websites and our Services are implemented with and operate on the Google Cloud Platform infrastructure which has multiple security standards certifications, including but not limited to: SSAE16 / ISAE 3402 Type II, ISO 27001, PCI DSS v3.0.

All data transfers to and from our Websites and our Services is encrypted using industry standard TLS.

All our Websites and our Services use Google Identity Platforms for secure, yet convenient user authentication.

All our Websites and our Services use only certified, reputable payment service Providers for secure processing of payments.

Authorized ApartSW Consulting personnel and our third party Providers may access your Account and your private information (but solely to the extend necessary to operate, maintain and improve our Websites or our Services or to respond to your support requests) and under strict contractual non-disclosure and confidentiality obligations.

Subject to the provisions in this Privacy Policy and any additional policies of the organisation they represent, organisation Administrators may, for all the Organisational Accounts their administer: (i) provide, access, delete or retain the Personal Information of the Account holder; (ii) monitor the information and activity associated to the Account; (iii) limit the Account holder's ability to access, update or delete the Personal Information or other information associated to the Account; and (iv) change the Account's login credentials, suspend the Account access or delete the Account. If you are an organisation Administrator it is your solely responsibility to ensure you have the right, authority, authorisation and user consent to do so.

Contact Information and Login Credentials

We are using Google Identity Platforms for secure user login authentication to all of our Websites and our Services. This means that only a certified Open ID Provider (like Facebook Connect, Google Plus or Google Identity Toolkit) will access and verify your login password for us, we do not have access to your password.

The Open ID Provider may also provide you the option to share certain Personal Information with us. The only Personal Information we obtain from the Open ID Provider is your email address and your name or alias.

You are solely responsible for maintaining the security and confidentiality of your login password with the Open ID Provider. We recommend that you always log out after each session on our Websites or our Services and close the browser when done, especially when using public or shared devices.

Your Personal Information may include additional contact information like mailing address or phone number if you voluntarily provide this information.

Unique Application Identifiers

Some of our Services may assign unique identifier numbers to downloadable software installed on your device. We may associate such identifiers with your Account when you install or update the respective downloadable software and use them for the purpose of providing you secure personalized access to the respective Services.

We treat these unique identifiers as Personal Information equivalent to your Account login credentials. We do not share these identifiers with any third party.

Email Address and Communications

We obtain your email address from certified Open ID Providers when you register for your Account or login to our Websites or our Services.

We send to your email address notifications about events or changes in your Account, payment transactions, changes in the operation of our Websites or our Services that you use, changes to provisions in our Agreements or Policies or other important notifications as set out in this Privacy Policy. You consent to receiving such notifications. You can not opt-out from such notifications.

When you register for our Websites or our Services, or at any time from your Account you may opt-out from email newsletters, promotional or evaluation messages about our Websites or our Services.

Some of our Services rely on event notifications which include email by default. You can opt-out or customize such notifications from the configuration menu of the respective Service or from your Account.

We may use email links in our Websites or our Services to allow you to contact us with questions, comments or other feedback you may have. We welcome these email communications and make efforts to respond to them where appropriate.

We may keep record of all email communications with you in order to help address issues you may encounter while using our Websites or our Services.

Administrators for Organisational Accounts may have access to records of the email communications for all the Accounts they administer, subject to the provisions in this Privacy Policy and any additional policies of the organisation they represent.

Payment Information

We are using only certified, reputable payment service Providers for secure processing of payments. This means we do not use, store or copy your credit card, debit card or other payment method information, this information is securely handled only by the certified payment service Providers which authenticate and process the payment transactions for us.

We are required by law to record your legal name, billing address and phone number for all payment transactions, which we obtain from the payment service Provider processing the respective transactions.
You are solely responsible to keep the Personal Information necessary for payment processing at the payment service Provider true, accurate, current and complete without exception.

Collaboration

Some of our Websites or our Services may provide collaboration features. Your email address and your name or alias will be visible to the other users you collaborate with.

Analytics

We use Google Analytics to obtain Anonymous Information like your browser, device type, screen size or how are you using our Websites and our Services in order to optimize and improve our Websites and our Services.
We do not share this information as-is with any third party. We may publicly disclose aggregated Anonymous data derived from the collected analytics information to display trends about the general use of our Websites or our Services.

Cookies and Similar Technologies

Our Websites and our Services and our third party Providers may use cookies and other digital markers stored on your device to remember information like user session identification, user settings, selected options, or other similar data. The information stored in these digital markers does not include any of your Personal Information but it contains keys that we and our third party service provides can use to reference the pieces of your Personal Information necessary to provide you with our Websites or our Services.

You can configure your browser options to stop accepting or to prompt you before accepting these digital markers from websites you visit. However if you do not accept the cookies you may negatively impact some portions or capabilities of our Websites or our Services, which may not function as expected.

Web beacons are electronic images that may be used in our Websites, our Services or the emails we send you to collect Anonymous Information about your usage of our Websites or our Services, and to determine whether you acted upon an email that we sent you.

Logs

Our Websites and our Services may log Anonymous Information about the requests they receive, like date and time of the requests, IP address of the device making the request, which URL was requested, other operational parameters of the request, errors encountered or other information relevant to the operation and maintenance of our Websites and our Services.

Authorized ApartSW Consulting personnel and our third party Providers may access the logged information (but solely to the extend necessary to operate, maintain and improve our Websites or our Services or to respond to support requests) and under strict contractual non-disclosure and confidentiality obligations.

Administrators for Organisational Accounts may have access to logs associated with activities in all the Accounts they administer, subject to the provisions in this Privacy Policy and any additional policies of the organisation they represent.

On occasion we may combine information from our logs with Personal Information we collect according to the provisions of this Privacy Policy. The combined information will be subject to this Privacy Policy just as the respective Personal Information.

Third Party Websites, Products and Services

Our Websites and our Services may contain links to or reference third party websites outside the apartsw.com domain. Such third party Websites are owned or operated independently of us and are not subject to this Privacy Policy or any ApartSW Agreements.
We expressly disclaim any responsibility or liability for the information contained on or collected by such third party websites as we have no control over their privacy practices whatsoever. It is entirely your responsibility to carefully read the privacy policy of such third party websites.

This Privacy Policy does not apply to third party products or services offered by other companies or individuals, whether they include some of our Services or not.

Disclosing and Sharing of Information

We do not share or disclose any of your Personal Information with third parties except as described in this Privacy Policy.

We do not sell, share or disclose any of your Personal Information that we collect to any third party for commercial or advertising purposes.

We may disclose your Personal Information to third parties (and only to the minimum extend necessary) if we have reasonable belief that such disclosure is required: (i) to comply with any applicable law, regulation, legal process or governmental request; (ii) to investigate potential violations of, and enforce applicable terms of service, agreements and policies; (iii) to protect the rights, safety and property of ApartSW Consulting, our customers and the public from harm, fraudulent or illegal activities as required or permitted by law; and (iv) to protect the security and integrity of our Websites and our Services.

Personal Information for Organisational Accounts may be disclosed to and accessed by the Administrators for the respective Accounts, subject to the provisions in this Privacy Policy and any additional policies of the organisation they represent.

Children under 13 Years of Age

Our Websites and our Services are not intended for use by children under 13 years of age. We do not intentionally collect Personal Information from children under 13 years of age. Upon written notification that a child under 13 years of age has provided us with Personal Information we will take the necessary steps to delete such Personal Information.

Business Transfers of Information

If ApartSW Consulting is involved in a merger, acquisition, or asset sale which requires any transfer of your Personal Information to a third party we will notify you of such upcoming transfer and of the choices you have regarding your Personal Information prior to the transfer.
